Private Listings, Public Platforms, and the Power of Choice

If it feels like real estate is constantly in the news lately, you're not imagining things. Between new rules from the National Association of Realtors (NAR) and tech companies making big moves, even seasoned homeowners are asking: What's really going on?

At the heart of the current debate is a rule called Clear Cooperation, which requires agents to post a listing to the MLS within 24 hours of any public marketing. On paper, it sounds fine. But in practice, it limits flexibility for homeowners and hands control to the MLS—and by extension, to platforms like Zillow.

The Zillow Factor

Zillow is now a licensed brokerage. It makes money by charging agents referral fees—sometimes as high as 40%—for leads that come through its site. When you click “Contact Agent” on a Zillow listing, you're not reaching the actual listing agent. You're getting routed to someone who paid for that lead. Meanwhile, the listing agent—the one who knows the home inside and out—is left out of the picture.

Now, Zillow wants to dictate how agents market listings and how quickly they appear on its site. Why? Because if listings show up elsewhere first—through private networks, exclusive listings, or “Coming Soon” campaigns—it hurts Zillow's ability to capture traffic and sell leads.
